The Financial and Consumer Services Commission of New Brunswick (Commission) is a leader in integrated financial and consumer services regulation. The Commission's mandate is to protect consumers and enhance public confidence in the financial and consumer marketplace through the provision of regulatory and educational services. With offices in both Fredericton and Saint John, it is responsible for the administration and enforcement of provincial legislation regulating mortgage brokers, payday lenders, real estate, securities, insurance, pensions, credit unions, trust and loan companies, cooperatives, unclaimed property, and a wide range of consumer legislation. The Commission is a self funded Crown corporation responsible for the administration and enforcement of financial consumer services legislation.

Legal Counsel or Senior Legal Counsel - Legal Services Division (Saint John Office)

As Legal Counsel or Senior Legal Counsel you will assist the Legal Services Division in providing legal research and advice to the Commission on a broad range of operational, regulatory and corporate matters to minimize risk to the Commission, while meeting business objectives.

Key responsibilities include reviewing and drafting legal documents, issuing legal opinions, and providing legal advice in relation to regulatory policy, corporate or operational functions of the Commission.

Your Focus

  • Legal Advice: Provide guidance on matters related to the Commission's regulatory, corporate and operational activities. Provide guidance on the interpretation and application of consumer services legislation, regulation, rules and internal policies.
  • Legal Research: Conduct legal and policy research to support the Commission's regulatory and strategic objectives.
  • Contract Formation: Draft, review, and negotiate various agreements, including vendor contracts, service agreements, non-disclosure agreements, and memoranda of understanding.
  • Procurement: Provide legal advice on procurement activities and the acquisition of goods or services under the Procurement Act Advise, including preparing Request for Proposals (RFPs) documents.
  • Legislative Compliance: Monitor compliance with local, provincial, and federal laws, and develop necessary compliance frameworks for the Commission.
  • Policy Review: Develop and review internal corporate policies and directives that align with the Commission's goals.
  • Risk Management: Identify legal risks, advise on mitigation strategies, and assist in problem resolution by evaluating and escalating issues.
  • Training and Education: Conduct legal training sessions for employees on relevant topics such as compliance with legislation, ethics, conflict of interest, and contract management.
  • Collaboration: Work with other divisions to provide legal support and promote compliance with applicable legislation.

What you bring

  • Law degree and membership in good standing or eligibility for membership to the Law Society of New Brunswick.

Legal Counsel:

  • 5 to 7 years of membership in good standing at the bar
  • Demonstrates basic knowledge and some relevant legal experience in the private or public sector, preferably in corporate/commercial law and contract drafting

Senior Legal Counsel:

  • Minimum of 7 years of membership in good standing at the bar
  • Extensive relevant legal experience in the private or public sector, preferably in corporate/commercial law and contract drafting
  • Independent decision making.
  • Ability to provide in-depth analysis of issues.
  • Proven management skills.
  • Superior research, analytical, writing, and communication skills.
  • Excellent communication and organizational skills and demonstrated leadership skills are required.

Additional Strengths

  • Written and verbal proficiency in both official languages is an asset.
