Job Description

We are currently seeking a qualified Claims Lead to join our Mining team, based out of either Calgary, Mississauga or Toronto or have the option for a 14/7 rotation to the project site in Leroy, SK. The Claims Lead will be responsible for leading and overseeing the mitigation and resolution of claims and disputes within the Projects Construction and Services contracts, ensuring accurate analysis, timely delivery, and effective client communication and have the opportunity to work on the Hatch Bantrel Joint Venture (HBJV). HBJV executes engineering and construction on the BHP Jansen Potash Mine Project in Saskatchewan. After successfully completing the Definition Phase Study for the project, the HBJV is currently carrying out the Detailed Engineering Phase for the Processing, Non-Process Infrastructure (NPI) and Mining Areas of the 4.5 Mtpa Stage 1 Potash Mine. With a published TIC of US $5.3-5.7 Billion this will represent one of the largest projects and private investments in Canada. The HBJV will use a hybrid of best-in-class new developing technologies and systems as well as the proven HBJV suite of tools to execute this exciting project. Duties & Responsibilities:

  • Collaborate with cross-functional teams to gather, consolidate, and analyze data
  • Develop and implement strategies for effectively presenting claims and resolving disputes, while adhering to industry best practices and relevant regulations
  • Lead meetings and discussions with clients, stakeholders, and legal teams to communicate complex information and support dispute resolution processes
  • Build and maintain strong relationships with Project personnel, providing valuable insights and guidance in dispute matters
  • Contribute to the identification of potential claims or disputes and work proactively to mitigate risks.
  • Develop and delivery ongoing training to Project personnel to address management of change and claims mitigation best practices
  • Support Project Contract Administrators by providing guidance on management of change issues
  • Write correspondence to contractors in support of management of change and claims
  • Manage and edit the Project Claims Log and Client Claims Register on an ongoing basis
  • Lead monthly the monthly review of the Project Claims Log with the Project Senior Leadership Team
  • Write and present ‘Claim Position Papers' and steward the monthly ‘Project Claims Report'
  • Support the Contracts Manager in the planning and implementation of commercial management activities as and when required
  • Analyze cost, labour, and labour productivity reports
  • Understand schedules, schedule acceleration, and extension of time analysis
  • Work with schedule and cost analysts to support the evaluation of delay, disruption, and prolongation claims
  • Interpret agreement standard terms and conditions to establish contractual entitlement in claims
Qualifications
  • Bachelor degree in Engineering, Law, Business, Accounting or a related field
  • Proven experience in claims and dispute resolution within the Energy, Mining and Infrastructure industries
  • Extensive knowledge in best practices and methods of construction claim analysis
  • Strong analytical skills and the ability to synthesize complex information into actionable recommendations
  • Proficiency in relevant software tools and platforms for claims and dispute resolution analysis
  • Effective written and oral communication skills, tailored for interactions within the infrastructure and legal contexts
  • If not on a site assignment rotation schedule, must have the willingness to travel, as needed to site in Leroy, SK
  • Strong project management skills to oversee multiple agreements simultaneously.
  • Experience using ERP systems, specifically SPF, Proliance or Procon
  • Excellent verbal and written communication skills including the ability to articulate to the project leadership team, client representatives, colleagues, contractors, and vendors
  • Highly analytical and problem-solving mind-set
  • Strong contract management, project management, and negotiation skills
  • Deep business development and client management skills
  • Good understanding of the principals of construction and contract law
  • Team-oriented personality
