We are currently seeking a Legal Administrator to join our team, reporting to our Toronto Head Office.

Reporting to the Vice President of Operations, the Legal Administrator is responsible for the management of all customer files/contracts that are assigned to our legal department, to better access and determine the level of action that will be required to remedy each case. This individual will also be responsible to: maintain the tracking/status for all legal files with our lawyers, track all legal cost as they apply to each file, and assist with the documentation and preparation of larger legal matters.

MAJOR RESPONSIBILITIES

  • Provide pre-legal action recommendations to senior management, sales and operations teams, informing when merchant/investors/distributors are in breach of contract or have compliance issues and financial implications of contracts and potential risks in legal pursuit.
  • Analyze if breaches of contract or compliance issues are feasible to pursue from legal and financial standpoint; seeking legal advice if necessary.
  • Draft correspondences, notices, demand letters, and settlement offers to merchant/investors/distributors to inform them of their contractual obligations when breach of contract or compliance issues are identified.
  • Liaise with Sales department for opportunities to retain merchant without legal action; guiding Sales Representatives to communicate with merchant to renegotiate new terms of contract or try to resolve matter amicably.
  • Pursue legal action against merchant, liaising with company lawyers when necessary.
  • Help senior management strategize and decide on the direction of open legal or litigation files, providing all necessary information collected, interpreting all documentation and providing recommendations.
  • Liaise with counsel across Canada to communicate information, instructions, or concerns in regards to ongoing contract based litigation, providing instruction to legal counsel based on senior management's advisement.
  • Respond to all information requests by legal counsel, working with other internal departments as necessary to obtain this information for legal action.
  • Attend settlement conferences, examinations for discovery, assessment hearings, mediations, arbitrations, and trials to provide evidence and instruction as the company's representative.
  • Supply recommendations on potential new business contracts or processes, reviewing contracts to examine accuracy of information and ensure terms are beneficial to company.
  • Review contract amendments with Sales Representatives to ensure their understanding.
  • Other duties related to the role, as necessary.

EDUCATION & TRAINING

  • Preference for University degree or College Diploma, with focus in Paralegal studies.
  • Licensed with the Law Society of Ontario.
  • At least 5 years of relevant work experience, if university degree, college diploma or Licensed is not obtained.
  • Alternative Dispute Resolution training, required.

EXPERIENCE, TECHNICAL SKILLS, & KEY COMPETENCIES

  • At least 3 years in working in an fast pace office environment.
  • Fully proficient in English (verbal and written).
  • Fully proficient in French (verbal and written), an asset.
  • Fully proficient in Microsoft office applications, including expert level in: Outlook; intermediate level in: Word, Excel, PowerPoint.
  • Knowledge of best practices for dealing with contracts and customers.
  • Understands how to defuse situations before they become problematic.
  • Critical Thinking, using logic and reasoning to identify the strengths and weaknesses of alternative solutions, conclusions or approaches to problems.
  • Strong time management and pays attention to detail.
  • Exudes confidence, patience, politeness, tact and diplomacy, when dealing with difficult situations.
  • Communication skills that allow you to inform, help and advice customers/staff clearly and to liaise effectively with other professionals.
  • Ability to conduct contract review, and understands the concept of contracts signed with clients, specifically: offer, acceptance, consideration, terms and outcome.
  • Ability to resolve breaches of contract issues or compliance issues using problem solving and negotiation skills.
  • Ability to independently identify contract issues and quantify damages arising from breaches of contract.
  • Ability to learn database management systems quickly and navigate complex systems with ease.
