Purpose of the RoleAs the Commercial Director at Worley, you play a vital role in providing governance, oversight, assurance and dispute/claims management for proposals and projects in Canada. The Commercial Director provides commercial leadership and subcontract management support to the Project Director, ensuring contractual obligations, financial performance, change management, claims avoidance, and subcontractor commitments are effectively managed throughout the project lifecycle. The primary focus will be for one of Worley's Major EPC Projects, which are the largest projects with the highest risk that Worley undertakes. Acting in accordance with the Commercial, Project Delivery responsibility and accountability framework, your role is instrumental in driving Worley's commitment to delivering a more sustainable world.
Key ResponsibilitiesCommercial Management
Act as the project focal point for prime contract and commercial matters, advising the project team and coordinating with legal or specialist support as required.
Maintain commercial alignment from handover through close-out, ensuring contractual obligations, notices, deliverables, and entitlements are understood and actively managed.
Oversee change management, claims avoidance, disputes support, and pursuit of commercial entitlement in partnership with the Project Director.
Coordinate client and Worley financial reporting, including cash flow, forecasting, billing issues, and commercial inputs to project reviews.
Establish and monitor as-sold budgets for revenue, cost, cash flow, and contingency, identifying corrective actions to maximize margin and protect cash position.
Support risk register development and ongoing contingency management, ensuring commercial risks and opportunities are visible and actively mitigated.
Manage client audits and capture lessons learned to improve commercial performance on future projects.
Worley-Customer Contract Management
Oversee project contractual obligations and coordinate with legal on interpretation of commercial compliance, liabilities, and contractual risk.
Ensure required certificates, insurances, guarantees, licenses, confidentiality agreements, and financial instruments are obtained, valid, and maintained in accordance with contract terms.
Support contract close-out by confirming commercial, financial, and contractual obligations are completed and documented.
Subcontracts and Supply Chain Management
Support procurement and subcontracting strategies to ensure alignment with the master EPC schedule, client requirements, approved budgets, cash flow, and contractual flow-downs.
Ensure procurement and subcontract commitments are commercially sound, appropriately controlled, and aligned with the client-approved commercial framework.
Construction, Fabrication and Commissioning Sub-contract Management
Work with Subcontract Administration and the Project Director to develop subcontracting strategies that support project delivery, schedule requirements, and commercial objectives.
Ensure subcontract packages include appropriate contractual flow-downs, payment terms, controls, insurances, licenses, certificates, and compliance requirements.
Monitor subcontract payments, commitments, and cost exposure against client-approved budgets and cash flow.
Support subcontract change management, notices, claims avoidance, dispute resolution, and close-out activities.
- University Degree or equivalent in related field or applicable discipline or equivalent relevant experience.
- Significant and relevant broad management experience, including commercial management roles.
- Experience in all project scopes and contracting regimes, but specifically in Fabrication, Construction, EPC & EPCM, FEED and engineering.
- Experience in Mega Projects with TIC > $1.0BN AUD.
- Experience in prime contract commercial management, /contractual disputes, claims and negotiations with customers.
